Please read these terms and conditions carefully before ordering any products from us. By ordering any products from us you are agreeing to these terms and conditions. The terms tell you who we are, how we will provide products to you, how you and we may change or end the Contract, what to do if there is a problem and other important information.

1.Definitions

"Contract" means the contract between us and you for the sale and purchase of the Products in accordance with these Terms

"Product" means a product set out in the Order "Order" means your order of the Products submitted by you online via the Website

"Terms" means these terms and Terms as amended from time to time in accordance with clause 10.1 "We/our/us" means Coffee Supplies Direct Ltd

3. Products

3.1 The images of the products on our Website are for illustrative purposes only. Although we have made every effort to display the images and colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the image and colour of the products. Your Product may vary slightly from those images.

3.2 The packaging of the product may vary from that shown on images on our Website.

3.3 We reserve the right to amend the product description if required.

3.4 All weights and sizes are supplied as a guide only and are approximate.

3.5 In the event that there are any errors regarding price or description, we reserve the right to correct that price or description and notify you accordingly. In these circumstances, it will be deemed that a contract has not been entered into and you will not be bound to continue with your purchase. We will cancel your Order and your credit/debit card or PayPal account will be refunded in full. The repayment of such monies paid to us will be the extent of our liability to you in the event of these errors.

3.6 Products which are on special offer or promotion are only available in limited qualities. When stock of a product on special offer or promotion runs out, we will no longer be able to supply that item at the special offer or promotion price.


4. Prices

4.1 All prices (where applicable) exclude VAT

4.2 VAT (where applicable) is calculated in the checkout section of the shopping cart at the current rate chargeable. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect. All prices are quoted in British pounds sterling (£ GBP) only.

4.3 The total value of your order including VAT and delivery charges will be displayed on the order confirmation screen. The displayed price is the amount in British pounds sterling (£ GBP) that you will pay. If you order by telephone, you will be notified by the operator of the amount payable.

4.4 Prices of the products and our delivery charges will be as quoted on our web site at the point of ordering (subject to revision for errors).

4.5 Our product prices and delivery charges are liable to change at any time. Any changes made to our product prices and delivery charges after a dispatch confirmation has been sent out to you will not affect any order which you have already placed. A dispatch confirmation is explained in more detail at 6.1 below.

4.6 Our web site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our web site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product's correct price is less that our stated price, we will charge the lower amount when dispatching the product to you. If a product's correct price is higher than the price stated on our web site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection.

4.7 We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation (see 6.1 below), if the pricing error is obvious and unmistakable and could reasonably been recognised by you as an error.

5.5 We will endeavour to deliver all the products you order. In the unlikely event of any product being out of stock at the time of order we will notify you of this and we will take steps to minimise the effect of the delay.

5.6 Whilst every effort will be made to ensure that all items shown in our on-line product catalogue are in stock we offer no guarantee of availability and our telephone service and this electronic publication does not constitute an offer for sale capable of acceptance by you submitting an order.

5.7 If ordering on-line, when we receive your order we will automatically send you an e-mail confirming acknowledgement of receipt of your order details ("Confirmation Email"). This Confirmation Email will be directed to the e-mail address you supplied to us upon placement of your order and is not a guarantee of availability nor acceptance of an offer.

5.8 If ordering over the telephone, once you have placed your order, you will be issued with a unique order reference number ("Unique Order Reference Number") - please quote this in case of any queries.

5.8 To ensure your order is dealt with promptly, we require your full, correct delivery address details, including a postcode for the United Kingdom, a day time contact telephone number and your e-mail address (if you have one). The billing address you provide to us must be the same as the billing address you have notified to and registered with your selected credit/debit card company or other payment services provider as this is used to validate your order. We regret that failure to supply the correct details will result in your order being held pending the supply of the correct details.

5.9 Your order will only be processed if full payment details are given.

5.10 Our Website accepts payment by most major credit cards and debit cards or by PayPal.

5.11 We use a third party payment services provider to process payments. If you are placing your order using our web site and select to pay by credit or debit card the final step in the ordering process will result in your order being handed over to our payment services provider's web site for payment. You may pay using any of the payment methods listed on our payment services provider's page after your order is transferred to their web site for payment. If you are placing your order by telephoning our customer services team the operator dealing with your order will advise you of the payment methods open to you and take your details. If you advise us that you wish to pay by credit or debit card your payment will still be processed using our third party payment services provider.

5.12 Your detailed payment information will be collected at the point you complete your order. In some circumstances order dispatch may be delayed due to unforeseen circumstances, and in this situation, depending on your payment method, payment debit will occur 3 to 7 days after you placing the order. Debiting your payment does not represent acceptance by us of your order or otherwise commit us to a contract with you. Section 6 of these terms will govern how and when a binding contract is formed between you and us in relation to any order.

This will be clear from the details presented to you in your browser during the order process. 6.4 If we are unable to accept your Order, we will inform of you this and will not charge you for the Product. This might be because the Product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because a credit reference we have obtained for you does not meet our minimum requirements, because we have identified an error in the price or description of the Product or because we are unable to meet a delivery deadline you have specified.


7. Cancellation of order & returns policy

7.1 You have a legal right to cancel a Contract under the Consumer Contracts Regulations 2013 within 14 days starting the day after the day on which the goods came into the physical possession of you the consumer or the person that you ask us to deliver the goods to. This means that during the relevant period if you change your mind or decide for whatever reason that you do not want to receive or keep the products, you can notify us of your decision to cancel the contract and receive a refund. Alternatively, you are entitled to request an exchange within the same period of time and the provisions below also apply to exchanges.

7.2 However, you do not have a right to cancellation in respect of the following products which can only be returned if they are faulty or not as described:

7.3 Your legal right to cancel a Contract starts from the date that we send you an email confirming that the Products have been dispatched which is when the Contract between us is formed and ends 14 days after you receive the product.

7.5 If the products have been delivered to you before you decide to cancel your contract you need to return the products to us, without undue delay and in any event no later than 14 calendar days from the day on which you communicate your wish to withdraw from the contract. You can return the products to the address given to you in the email in which we acknowledge your wish to withdraw from the contract. Please insert a copy of your delivery note into your return parcel and retain your receipt or proof of postage

7.6 Please return the products to us in perfect, re-saleable condition (including product packaging, instructions, etc). You must not write anything on the item, its packaging or instructions. Please note that the costs of returning your item(s) must be paid by you and at your own risk no later than 14 calendar days from the day on which you communicate your decision to withdraw from the contract, we recommend using a trackable service and obtaining proof of postage. On your request and for your convenience, our customer services team can provide you with a return label to simplify the shipment process. We will inform you what the return shipment costs will be and that the return shipment cost will be deducted from any eligible refund.

7.7 Take care of the products whilst they are in your possession, as you have a legal obligation to do so.

7.8 If you cancel your Contract with us, we will:

7.8.1 Refund you the price you paid for the products. However, please note we are permitted by law to reduce your refund to reflect any reduction in value (which may be as much as the Contract price), if this has been caused by you using the product or handling the product in a way which would not be permitted. If we refund you the price before we are able to inspect the products and later discover you have used them or handled them in an unacceptable way, you must pay us an appropriate amount (which may be as much as the Contract price);

7.8.2 Refund any delivery costs you have paid, although, as permitted by law, the maximum refund may be the costs of delivery by our basic delivery charge (return costs shall be paid by you)

7.8.3 We will return your money to you by re-crediting it to the payment method you used to pay for the products without undue delay and in any case within 14 days of the day we have received the products you wish to return or until you supply evidence that you have sent the products back to us, whichever is the earliest.

7.9 Due to the speed of our ordering process we may not be able to cancel your Order before dispatch. If you exercise your right to cancel prior to receiving the products, we will attempt to stop the products from being delivered to you. However, it this is not possible and the products are delivered, you will be able to return them in line with your rights set out above.

7.10 Goods returned because they are faulty or defective must be returned in the condition you received them. For UK orders, we will pay the cost of returning the item(s) to us.

8.2.1 Should a fault occur with the item(s) within 30 days of delivery you will be offered the choice of a replacement or refund.

8.2.2 If there is a fault with your product or other defect with your order within 12 months of delivery we will normally offer a replacement or repair from us or through our approved suppliers or agents. (Exclusions apply)

8.2.3 On returning faulty items ensure you adhere to the returns guidelines as outlined above. Failure to meet these conditions may result in your return not qualifying for a refund or replacement.

9.13 All orders require a signature. All valuable orders are shipped using an insured service by Interlink. Smaller or less valuable orders are shipped by MyHermes. We reserve the right to charge more for delivery if the order is to be delivered to a remote or rural area as signified above, or for very large or valuable items. We will always contact you to discuss the options before making additional delivery charges.

9.14 We reserve the right to alter our delivery charges in future without warning. Any changes made will be advertised on this page. We reserve the right to refuse delivery of we deem it necessary, or to charge for delivery where the wrong delivery type is specified. We reserve the right to refuse service in exceptional circumstances. We reserve the right to deviate from our published delivery charges if necessary

9.15 Working Days and Bank Holidays

9.15.1 Working days - are Monday to Friday excluding UK Bank Holidays. E.g. an order placed on a Friday for Next Day Delivery will be delivered on the following Tuesday.

9.15.2 Bank Holidays are not normal working days and therefore are not available for delivery and should not be included in processing times.

9.16 If no one is available at your address to take delivery and the Products cannot be posted through the letterbox, we will either attempt to deliver to a neighbour or we will leave you a note informing you of how to rearrange delivery or collect the products from your local delivery depot.

9.17 Subject to section 5.8 above, deliveries will be made to the address that you have nominated. The products will be at your risk from the time of delivery. In the event that you select a business address, we shall be deemed to have delivered the product to its intended recipient by delivering it to the reception area at the business address. However, if an express delivery has been selected, your signature will be required or the products will not be delivered.


10. Sales Calls

10.0 If you have given your consent on during making your purchase for our Sales Team to contact you via telephone on a periodic basis with the details of new product ranges and offers, these calls will only occur between 9am-5pm on weekdays. Your telephone number and personal data will be secured and will not be released to any third parties during or after this process. You can opt out of receiving calls from our Sales Team any time by informing us verbally in person or during a telephone call, email or via our postal address.


11 General

11.1 We reserve the right to amend these Terms and Conditions for any reason at any time. It is your responsibility as a customer to review these on each occasion you access the Coffee Supplies Direct web site or by telephoning our customer service team. Coffee Supplies Direct has complete discretion to modify, remove or suspend any part of this site without warning or liability arising from such action.
